Resum: | El stalking es un anglicismo que refiere a conductas constitutivas de acoso, acecho u hostigamiento y que hasta 2015 no contaba aun con una incriminación específica en el Código Penal español, pese a que se intentaba subsumir las conductas que pueden conformar el tipo (llamadas telefónicas, envío de cartas o mensajes, paquetes, merodeos o seguimientos) en otros tipos penales existentes, denotando dificultades que evidenciaban la necesidad de contar con una regulación concreta. La criminalización de tales conductas requiere un estudio en profundidad de la situación en los países precursores de su tratamiento, tanto a nivel cuantitativo como cualitativo, estudiando el concepto, las características de autores y víctimas, y el tratamiento en sus Códigos Penales. El presente texto muestra a través de una investigación cualitativa la experiencia y procedimientos de actuación de profesionales frente a este tipo delictivo por tal de comprender cómo es el circuito de intervención. El desconocimiento del stalking y el reciente interés del Derecho penal español por criminalizar este fenómeno han denotado la ausencia de investigaciones sobre la cuestión. De ahí, el interés de este trabajo por indagar en la cuestión y aportar una nueva perspectiva de conocimiento sobre las pautas de tratamiento del stalking en España y, concretamente, Cataluña. |
Resum: | Stalking is an Anglicism that refers to conducts that constitute harassment, and that until 2015 did not have even a specific incrimination in the Spanish Penal Code, despite it was tried to subsume behaviors that can shape the type (phone calls, sending letters or messages, packets, loitering or tracking the victims) on other existing criminal offenses, there were found difficulties that made evident the needing for a specific regulation. The criminalization of these behaviors requires a thorough study of the situation in the early adopters of its treatment, both quantitatively and qualitatively, studying the concept, the characteristics of perpetrators and victims and the treatment in their Criminal Codes. This text shows through a qualitative research the experience and procedures for professionals who tackle this type of crime in order to understand how the circuit of intervention works. Ignorance of stalking and the recent interest of Spanish criminal law to criminalize this phenomenon have denoted a lack of research on the issue. Hence, the interest of this study is to inquire into the matter and bring a new perspective of knowledge about treatment guidelines of stalking in Spain and specifically in Catalonia. |
