Abstract:	L'objecte del present treball és analitzar amb profunditat la figura de la gestació per substitució juntament amb tota la seva regulació a nivell internacional i estatal. S'ha donat gran interès a una qüestió molt controvertida en l'actualitat com és la determinació de la filiació dels nens nascuts a través d'aquesta tècnica, demostrant la urgent necessitat de regular aquesta matèria a l'Estat Espanyol. La confrontació i l'entrada en joc de l'ordre públic i l'interès superior del menor serà objecte d'anàlisi jurídic a través de diversa jurisprudència i doctrina dels nostres tribunals i de la Instrucció de la Direcció General dels Registres i del Notariat.
Abstract:	The purpose of this work is to analyze in depth the figure of surrogate motherhood along with all its International and national regulation. It has been given a great interest to a controversial question nowadays as it is the determination of the filiation of the children born through this technique, demonstrating an urgent need to regulate this technique in the Spanish state. The confrontation of the public order and the best interest of the child will be object of legal analysis through the jurisprudence and doctrine of our courts and the Instruction of the general Directorate of Registries and Notary.
