El presente estudio busca destacar los principales antecedentes acerca de la compleja relación entre los seres humanos y los animales, aproximándonos a las fuentes materiales que influyeron en la creación, transformación y/o derogación de las distintas normas jurídicas que, finalmente redujeron a los animales al ámbito de las cosas u objetos del derecho. Simplificando el estudio de la cuestión animal, desentrañaremos la escasa, pero relevante bibliografía al respecto, desde las variadas normas jurídicas de la antigüedad, pasando por los extravagantes juicios medievales, hasta llegar a los inéditos tratados internacionales, constituciones, leyes y ordenanzas, que en la actualidad propugnan el reconocimiento de los derechos de los animales. En este breve análisis, se presentan variadas concepciones filosóficas, religiosas y culturales, que nos permiten instalarnos en el amplio debate de los principales temas del Derecho Animal, el mismo que en las últimas décadas se ha venido popularizando, a partir de la publicación de Liberación Animal de Peter Singer en 1975, y de la iniciativa de la Declaración Universal de los Derechos de los Animales en 1977. Además, repasaremos rápidamente los avances en el reconocimiento de la dignidad animal, analizando el artículo 20 de la Constitución alemana de 2002, el reconocimiento de los derechos de la naturaleza en las Constituciones de Ecuador 2008 y Bolivia 2009, la positivización de los animales como seres sintientes en el Código Civil colombiano 2016; así como la normativa ecuatoriana en esta materia. |

This study seeks to highlight the main historical antecedents of the complex relationship between human beings and animals, bringing us closer towards the material sources that influenced the creation, transformation and / or derogation from different legal regulations that ultimately reduced animals to the realm of things and objects of law. Simplifying the study of the animal question, we will unravel the scarce but relevant bibliography in respect of this, from the various legal regulations of antiquity, through extravagant medieval trials, arriving at unpublished international treaties, constitutions, laws and ordinances that nowadays support the recognition of animal rights. This brief analysis presents varied philosophical, religious and cultural conceptions that allow us to involve ourselves in the wide debate on the main topics of Animal Law that have grown in popularity in recent decades, starting with the publishing of Peter Singer's Animal Liberation in 1975, and of the initiative of the Universal Declaration of Animal Rights in 1977. Furthermore, we will quickly look over the advances in the recognition of animal dignity, analysing Article 20 of the German Constitution of 2002, the recognition of the Rights of Nature in the Ecuadorian Constitution of 2008 and the Bolivian Constitution of 2009, and the recognition of animals as sentient beings in the Columbian Civil Code of 2016, as well as Ecuadorian regulations on this topic. |
