La opinión dominante es que el derecho romano no conocía las cláusulas de reserva de dominio (pactum reservati dominii), por lo que se considera una invención del ius commune medieval. Esta opinión es cierta en la medida en que la retención o reserva del dominio era ineficaz desde el punto de vista romano porque el comprador, como poseedor, estaba siempre en posición de adquirir la propiedad por prescripción adquisitiva (usucapio), cumpliéndose en estos casos el requisito de la buena fe. In Roman law scholarship the view prevails that there was no retention of title clause (pactum reservati dominii), this clause is considered being rather an invention of medieval ius commune. This view is correct given the fact that retention of title was ineffective from the point of view of Roman law insofar as the buyer, being also the possessor, could always acquire ownership by means of prescription (usucapio) since the requirement of good faith was normally fulfilled. This article highlights the subordination of the seller's liability to the protection granted to the buyer in the context of the sale of someone else's property. The rationale behind the solutions of the Chilean Civil Code is illustrated through a historical and comparative analysis, identifying two peculiar features which set it apart from other legal systems: the inexistence of a general system of a non domino acquisitions and the burden of the buyer to defend himself with all available means in order to seek responsability from the seller.
