En 2018 la Suprema Corte de Justicia de la Nación (en adelante SCJN) aprobó la resolución 163/2018, que establece un importante precedente al considerar el bienestar animal como principio implícito de la Constitución y como límite al derecho a la cultura y a prácticas culturales que resultan contrarias a los principios de un Estado democrático de Derecho.
In 2018 the Supreme Court of Justice of the Nation, passed Resolution 163/2018, establishing the important precedent of considering animal welfare as an implicit principle in the Constitution and as a limit to the law and to culture and cultural practices that go against the principles of a democratic state of law.

Ante las dudas que suscita Real Decreto 463/2020, de 14 de marzo, por el que se declaró el estado de alarma ocasionada por el COVID-19, y de otros Decretos y normas que le siguieron, el autor del presente trabajo considera como actividad esencial, excluida de cualquier confinamiento estricto, tanto la apertura de todo centro clínico veterinario como la posibilidad de circular con animales de compañía (siempre que se haga en su propio interés), no solo atendiendo al espíritu de aquellos Decretos y normas, sino, más en general, conforme a la nueva realidad social y jurídica, europea y nacional, que estima a los animales como seres sintientes (como seres vivos dotados de sensibilidad), y que ha venido a consagrar, como nuevo Principio General del Derecho, la necesaria protección del bienestar animal.
