El Código Penal castiga a los que maltraten cruelmente o abandonen a un animal doméstico en condiciones en las que peligre su vida o integridad con la pena de multa. En la presente sentencia se impone una multa económica al maltratador y también se ordena la retirada de la posesión del animal.
The penal Code punishes those who cruelly mistreat or abandon a domestic animals (a pet) in conditions that endanger their lives or integrity with a fine. In this sentece, the judge impose a fine and orden the withdrawal of the posesión of the animal.

La relación existente entre el veterinario y el dueño del gato que acude a su consulta es un contrato de servicios veterinarios, cuya obligación principal es una obligación de medios. La responsabilidad contractual deriva, entonces, del daño producido por una actuación negligente del veterinario y debe resarcir el daño material y el daño moral producido por la muerte del animal.
The relation that exists between the veterinary and the owner of the cat who comes to his office is a veterinary services contract, which main obligation is just a media obligation. Therefore, the contractual liability derives from de damage caused by a veterinarian's negligence, and he must compensate the material damage and the moral damage produced by the animal's death.

En el presente artículo se realiza un comentario a la Sentencia 135/10 del Juzgado de lo Penal nº 4 de Bilbao (Bizkaia) de 25 de marzo de 2010 que castiga de forma pionera por un delito de maltrato a animales domésticos un comportamiento omisivo, el absoluto abandono de seis perros en pabellón dejándolos sin mínimas condiciones de alimentación e higiene causando la muerte de uno y lesiones graves de otros.
The article comments the judgment of court nº 4 of Bilbao dated 25/03/2010, that blams inusually for a crime of animal mistreatment: the serious abandonment of six dogs in a pavillon, without food, hygiene or care, that caused death to one of them and wounds to the others.
