Sintiencia animal : necesidad de un reconocimiento jurídico material, y sus implicaciones teóricas y prácticas

Los animales no humanos que ostentan la calidad de seres sintientes, son sujetos de consideración moral y, por tanto, titulares de derechos morales. Esto debe reflejarse en el mundo del derecho, que debe reconocer jurídicamente esa sintiencia, lo que hace necesaria la edificación una categoría jurídica propia para ellos, que los defina jurídicamente, y les reconozca unos derechos mínimos inviolables que se derivan, necesariamente, de la condición biológica de seres sintientes, a saber: el derecho a la vida, a la libertad, a la integridad y a la dignidad. Nonhuman animals qualified as sentient beings are subjects of moral consideration and are therefore holders of moral rights. This must be recognized in the legal world, which must legally recognize such sentience, making it necessary to construct a legal category specifically for them that legal defines them and recognizes minimum inviolable rights that necessarily derive from the biological condition of sentient beings, which are the right to life, to freedom, to integrity and to dignity. The legal status of animals in the Civil Code is in need of a modification that updates and modernises their treatment and ensures it meets the needs and demands of society. This work addresses the key points of the modification that, the initial proposal having been interrupted by unexpected political circumstances, is still underway, awaited since 2017 when the parliament approved the Civil Code recognition of animals as sentient beings, as opposed to things, as they appear in the current version, which ultimately allows them to be assimilated with inert objects. Fundamentos éticos de las políticas públicas de la guarda responsable de animales y la pandemia de la COVID-19

Este trabajo trata de una nueva propuesta que es el concepto de la guarda responsable de la naturaleza y de los animales, es decir, una evolución de la noción de tenencia responsable de mascotas. Los retos planteados por la pandemia de la COVID-19 señalan la importancia de establecer esta nueva expansión del concepto de guarda responsable que, teniendo como premisas teóricas no solo la ética patocéntrica, sino también una ética biocéntrica del cuidado, buscaría por lo tanto extender el círculo de protección ofrecido por el concepto de guarda responsable de mascotas que avanzaría de los animales de compañía para abarcar a los demás seres sentientes y la naturaleza en general, una expansión que se llevaría a cabo bajo el prisma holístico de la salud única, o sea, ambiental, animal y humana. This work deals with a new proposal that is the concept of the responsible guardianship of nature and animals - a concept that is an evolution of the concept of responsible pet ownership. The challenges posed by the COVID-19 pandemic point to the importance of establishing this new expansion of the responsible guardianship concept which, having as a theoretical premises not only pathocentric ethics, but also a biocentric ethics of care, would therefore seek to extend the circle of protection offered by the concept of responsible pet care that would advance from companion animals to encompass other sentient beings and finally encompass nature in general.
