Presentamos un análisis jurídico de un criterio emanado del Poder Judicial de la Federación (México) que sostiene que la posesión de ejemplares disecados o en taxidermia de especies protegidas no configuran el delito contra la biodiversidad establecido en el Código Penal Federal, a través de la argumentación y la lógica jurídica concluimos que el criterio es irracional por establecerse en falacias y errores crasos.
We present a legal analysis of a judgment made by the Judicial Power of the United Mexican States that holds that the possession of preserved specimens or taxidermy of protected species does not amount to the crime against biodiversity established in the Federal Criminal Code, and through legal reasoning and logic we conclude that the judgment is irrational due to its basis in fallacy and severe errors.
