El proceso de europeización del Tribunal Constitucional

This study analyzes the process of Europeanization of the Spanish Constitutional Court. From the beginning, when the Constitutional Court considered Community Law as something absolutely alien to the domestic constitutional text and, therefore, as something absolutely alien to its own jurisdiction, up to the present, in which the Constitutional Court seems to point towards a possible recognition of Union Law (specifically, of its Charter of Fundamental Rights) as a direct constitutional parameter subject to the ultimate jurisdiction of the Constitutional Court itself.
El present estudi analitza el procés d'europeïtzació del Tribunal Constitucional. Des dels inicis, quan el Tribunal Constitucional considerava el Dret comunitari com una cosa absolutament aliena al text constitucional domèstic, i, per tant, com una cosa absolutament aliena a la seva jurisdicció, fins a l'actualitat, en la qual el Tribunal Constitucional sembla apuntar cap a un possible reconeixement del Dret de la Unió (concretament, de la seva Carta de Drets Fonamentals) com a paràmetre directe de constitucionalitat sotmès a la jurisdicció última del propi Tribunal Constitucional.
El presente estudio analiza el proceso de europeización del Tribunal Constitucional. Desde los inicios, cuando el Tribunal Constitucional consideraba el Derecho comunitario como algo absolutamente ajeno al texto constitucional doméstico y, por tanto, como algo absolutamente ajeno a su jurisdicción, hasta la actualidad, en la que el Tribunal Constitucional parece apuntar hacia un posible reconocimiento del Derecho de la Unión (concretamente, de su Carta de Derechos Fundamentales) como parámetro directo de constitucionalidad sometido a la jurisdicción última del propio Tribunal Constitucional.
