La presumpció d'innocència és una garantia que neix com a resposta a innombrables abusos històrics per part del poder, en totes les seves manifestacions, servint-se del ius puniendi en el procediment penal inquisitiu, i es en el nostre temps un element transcendental del nostre procés penal, la rellevància del qual el proveeix de caràcter de dret fonamental i, per tant, del màxim contingut axiològic en el nostre ordenament jurídic.
La presunción de inocencia es una garantía que nace como respuesta a innumerables abusos históricos por parte del poder, en todas sus manifestaciones, sirviéndose del ius puniendi en el procedimiento penal inquisitivo, y es en nuestro tiempo el elemento trascendental de nuestro proceso penal, cuya relevancia lo dota de carácter de derecho fundamental y, por tanto, del máximo contenido axiológico en nuestro ordenamiento jurídico.
The presumption of innocence is a guarantee that arises as a response to countless historic abuses of power in all its manifestations, using ius puniendi in the inquisitorial criminal procedure. In our time, it is a crucial element of our criminal process, whose relevance endows it with the character of a fundamental right and, therefore, the maximum axiological content in our legal system.
