Desde hace dos décadas en Latinoamérica y en los últimos años en Europa, se vive un auge de partidos y movimientos políticos populistas que apoyan una reformulación diversa de las reglas de la democracia liberal. Uno de los elementos más característicos del populismo es su concepción fuerte del poder ejecutivo, al que se considera como interlocutor y representante necesario de un poder constituyente a cuya acción constante se confía el deseado cambio político. El presidente, ya de la República, ya del gobierno populista adquiere un poder especialmente relevante que le lleva a imponerse a los restantes poderes del Estado. Es un líder carismático que establece una relación mesiánica con el pueblo al que se pasa a ver como un todo uniforme de cuya voluntad el presidente es el único intérprete válido. En el presente artículo, y mediante un método inductivo-deductivo, se trata de aportar una explicación tanto al populismo como ideología, como a la trascendental im- portancia que se da a la figura del presidente. Se concluye que el populismo es una reformulación del totalitarismo de corte schmittiano y que el rol protagónico dado al presidente procede de una concepción premoderna y primitivista de la política. |

This article aims to analyze the relationship between transitional justice and citizen participation towards achieving true justice with truth, reparation and guarantees of non-repetition. The article is developed in three chapters: a first part analyzes the relevant aspects of transitional justice at the international level (State responsibility and obligations); a second part studies the importance of the Comprehensive System of Truth, Justice, Reparation and Non-Repetition, looking at aspects such as its implementation in Colombia (novelties in restorative justice aimed at improving the system); Finally, a look is taken at the guarantees of non-repetition that are framed in the scenarios of citizen participation and the oversight developed within the framework of the peace and post-conflict agreement. It concludes with some reflections on transitional justice and citizen participation indicating that, even when the victims must be the center of justice, there are few guarantees for the exercise of participation scenarios created by law. This article is carried out under an analytical-systematic method where bibliographic and documentary sources are reviewed that allow the reader to have a clearer picture of the subject. |
