| Abstract: |
La gestación por sustitución está permitida y regulada en el Reino Unido desde 1985. Aunque inicialmente la legislación estaba más orientada a desincentivar dicha práctica y a proteger los menores involucrados, la experiencia de todos estos años ha sido positiva, e incluso se encuentran inmersos en un debate social y legal para reformar la ley, para cambiar y mejorar aquellos aspectos que han quedado obsoletos, o que se han demostrado constituir un obstáculo para formar una familia y reconocer una nueva forma de filiación. Igualmente, el Reino Unido ha sido capaz durante todos estos años de producir suficiente evidencia empírica sobre el bienestar emocional de los niños/as concebidos mediante gestación por sustitución, sobre las satisfactorias relaciones paterno filiares y familiares en general de estas familias, así como de las razones altruistas de las gestantes que se prestan a gestar a estos bebés para otras parejas. Por lo tanto, en la actual discusión legal, social y ética en España, sería interesante estudiar y tomar nota de la experiencia británica en gestación por sustitución, país con el que compartimos mayores similitudes sociales, culturales y hasta normativas en materia de reproducción asistida, que otros países o contextos sociales. |
| Abstract: |
Surrogacy has been allowed and regulated in the United Kingdom since 1985. Although initially the legislation was more oriented towards discouraging this practice and protecting the minors involved, the experience of all these years has been positive, and they are even immersed in a social and legal debate to reform the law, and change and improve those aspects that have become obsolete, or that have been shown to be an obstacle in this way to form a family and recognize a new form of filiation. Likewise, the United Kingdom has been able during all these years to produce sufficient empirical evidence on the emotional well-being of children conceived by surrogacy, on the satisfactory parental and family relations in general of these families, as well as on the altruistic reasons of the gestating women. Therefore, in the current legal, social and ethical discussion in Spain, it would be interesting to study and take note of the British experience in surrogacy, a country with which we share greater social, cultural and even normative similarities in terms of assisted reproduction, than other countries or social contexts. |
