Abstract:	Con la reforma de la Ley 16/2022, el nuevo artículo 435. 3 del Texto Refundido de la Ley Concursal admite, bajo ciertas condiciones, que un pacto convencional para darse preferencia y postergación recíproca entre acreedores sea reconocido y ejecutado dentro del concurso del deudor común. Se trata de una excepción al régimen imperativo de pago de créditos conforme a la calificación de créditos concursales.
Abstract:	Law 16/2022 introduces the new article 435. 3 of the Consolidated Text of the Insolvency Law admits, by which under certain conditions a conventional agreement to give reciprocal preference or postponement between creditors shall be recognized and executed within the common debtor's bankruptcy. This is an exception to the mandatory regime of payment of credits according to the classification of insolvency claims.
