Abstract:	Se analizan los principales casos judiciales británicos, españoles y comunitarios que han debido resolver si las habituales cláusulas de ley aplicable y convenio arbitral de los seguros de protección e indemnización son o no oponibles al tercero perjudicado por las acciones del armador asegurado. En Derecho británico, se considera oponible, al igual que en Derecho español desde la sentencia "Seabank" de 2003. No obstante, el Tribunal de Justicia de la Unión Europea en en caso "Prestige" de 2022 considera que el convenio arbitral no puede ser oponible al tercero perjudicado que ejerce la acción directa contra el asegurador de responsabilidades civiles marítimas.
Abstract:	The content is the analysis of the main British, Spanish and European court cases that have had to resolve whether the usual clauses of applicable law and arbitration agreement of whether protection and indemnity insurance are enforceable or not against the injured third party by the actions of the insured shipowner. In British Law, it is considered opposable, as in Spanish Law since the "Seabank" judgment of 2003. However, the Court of Justice of the European Union in the "Prestige" case of 2022 considers that the arbitration agreement cannot be opposable to the injured third party who exercises direct action against the maritime civil liability insurer.
