Debilidad regulatoria de los transgénicos en Guatemala; alternativas, riesgos, amenazas e intereses

Abstract: La introducción en Guatemala de los Organismos Genéticamente Modificados (OGM), conocidos también como transgénicos, se ha dado en un marco jurídico e institucional con muchas debilidades y sin ninguna ley que los regule hasta el día de hoy. Los transgénicos ingresaron en Guatemala cuando algunas empresas iniciaron a experimentar con productos agrícolas en 1989, además se han introducido como ayuda alimentaria proveniente de Estados Unidos. En la actualidad sectores políticos, sociales y académicos se pronuncian al respecto, entablándose un profundo debate por el grado de incertidumbre e intereses comerciales que existe sobre los OGM. Por un lado se toman a los transgénicos como alternativa agrícola por la posible productividad que se obtendría con este tipo de semillas, aunque no haya evidencia que esto sea así, pretendiendo únicamente aprovechar la coyuntura por empresas productoras de transgénicos para posicionarse en el mercado regional. Por otro lado, no se cuenta con estudios concluyentes sobre los impactos de los OGM a la biodiversidad y efectos hacia la salud humana, constituyéndose así como una amenaza para los pequeños agricultores, habiendo mucha oposición por parte de grupos sociales y académicos. Este trabajo, tiene como propósito analizar el marco legal e institucional sobre los transgénicos y sobre todo las diferentes posiciones de los sectores para ampliar la limitada información y propiciar un mejor conocimiento sobre los OGM en Guatemala.
Abstract: The introduction in Guatemala of the Genetically Modified Organisms (GMO 's), also known as transgenic, has occurred in a context where the legal and institutional framework presents many weaknesses and there is no law that regulates them until today. The transgenic entered in Guatemala when some companies began to experiment with agricultural products in 1989, also have been introduced as food aid from the United States. Nowadays, political, social and academic sectors are remaining silent on the matter; they threw a deep debate by the degree of uncertainty and commercial interests that exists on GMO 's. On the one hand transgenic are taken as agricultural alternative by the possible productivity that would be obtained with this kind of seed, and the companies take advantage of the situation to position itself in the regional market. On the other hand, there are no conclusive studies on the impacts of GMO 's on biodiversity and effects to human health, as well as constituting a threat to small farmers, having much opposition on the part of social groups and academics. This paper has as purpose to analyze the legal and institutional framework on transgenic and on all the different positions of the sectors to expand the limited information and promote a better understanding on GMO's in Guatemala.
