Durante los días 7 y 8 de noviembre de 2017, la Magistrada titular del Juzgado de Instrucción nº 1 de Lugo, María del Pilar de Lara Cifuentes, se percató de una noticia aparecida en los diarios lucenses y en las redes sociales, en la que se informaba de que se había lanzado a un perro al vacío desde una vivienda del Camiño Real de Vigo. El mismo día 9 de noviembre incoó de oficio un procedimiento penal por un presunto delito de maltrato animal tipificado en el art. 337 del Código Penal (en adelante CP). Practicadas la diligencias instructoras pertinentes, la titular del Juzgado dictó un Auto por el que acordó una serie de medidas cautelares sobre los dueños de Catalina: el decomiso del animal herido, la atribución de su guarda y custodia a una sociedad protectora de animales, la prohibición a los investigados de acercarse o comunicarse con el hospital veterinario, con la sociedad protectora o con el propio animal y la prohibición a los investigados de la tenencia de animales. |

Throughout 7 and 8 November 2017, the Magistrate in charge of the Instructional Court number 1 of Lugo, María del Pilar de Lara Cifuentes, noticed the news that appeared in different Lugo newspapers and social networks, in which it was reported that a dog had been thrown into the void from a house in Camiño Real de Vigo. On the same day, November 9, she initiated an ex officio criminal proceeding for an alleged crime of animal mistreatment, typified in article 337 of the Spanish Criminal Code. Once the pertinent investigative procedures had been carried out, the Judge issued an order that contained a series of interim measures applied against the owners of Catalina: the confiscation of the injured animal, the attribution of its custody to an animal protection society, the interdict to the indicted persons to approach or to communicate with the veterinary hospital, the protective society or the animal itself and the banning to the indicted persons of the possession of animals. |
