Abstract:	El presente trabajo tiene por objeto analizar los límites entre el ilícito penal y el ilícito administrativo en el ámbito de la prevaricación. Para ello se propone una revisión del bien jurídico tutelado por el art. 404 CP.
Abstract:	The purpose of this work is to analyze the boundaries between criminal and administrative offences in the area of prevarication. To this end, a revision of the legal interest protected by Article 404 of the Penal Code is proposed.
