Un revés europeo al arbitraje londinense : la anti-suit injunction es incompatible con el Derecho comunitario

Abstract: El objetivo de este artículo es comentar los efectos de la sentencia del TJCE que considera que la concesión de una anti-suit injunction inglesa por estimar que el procedimiento judicial ante otro Estado miembro sería contrario a un acuerdo arbitral es incompatible con el Reglamento nº 44/2001 El Tribunal indica que aunque la anti-suit injunction no entra en el ámbito de aplicación del Reglamento, puede tener consecuencias contrarias a su efecto útil. Además, señala expresamente que el juez que sea competente en virtud del Reglamento 44/2001 tiene la exclusiva para pronunciarse sobre la cuestión previa relativa a la validez y eficacia del convenio arbitral y, además, su decisión se incluye en el ámbito de aplicación de dicho Reglamento. Considera que si por la mera invocación de una parte, el juez se abstuviese, vulneraría el derecho a la tutela judicial efectiva de la parte que considera que dicho convenio es nulo, ineficaz o inaplicable. El autor realiza un pronóstico sobre los efectos jurídicos y legales de la sentencia sobre las anti-suit injunctions en Europa y a nivel internacional y de Londres como sede de arbitraje marítimo.
Abstract: The aim of this article is to discuss the judgement of the CJEC (case c- 185/07, Allianz and Generali v. West Tankers) that finds incompatible with Regulation nº 44/2001 to grant an anti-suit injunction on the ground that proceedings before the court of another Member State would be contrary to an arbitration agreement. The Court says that even though the anti-suit injunction do not come within the scope of Regulation, it may nevertheless haba consequences which undermine its effectiveness. Furthermore, it is exclusively for the Court in the exercise of the powers conferred on it by Regulation No 44/2001 to rule on a preliminary issue concerning the applicability of an arbitration agreement. This verification must be considered as falling within the scope of application of Regulation as well. The Court considers that if a anti-suit injunction takes effect, a party could avoid the proceedings merely by relying on the alleged arbitration agreement and the applicant, which considers that the agreement is void, inoperative or incapable of being performed, would therefore be deprived of a form of judicial protection to which it is entitled. The author forecasts the legal and commercial effects of this judgement on the anti-suit injunctions in the EU and worldwide and on London as a maritime seat of arbitration.
