La valoración del suelo no urbanizable afecto a sistemas generales. De su contribución a 'crear ciudad' a la negación de expectativas urbanísticas en el valor del suelo

Abstract:	Desde mediados de la década de los noventa del siglo pasado, se vino fraguando en los tribunales un cuerpo jurisprudencial que avalaba la desconexión entre valoración y clasificación de suelo en el caso de terrenos destinados a sistemas generales que se clasificaran como no urbanizables o carecieran de clasificación específica. Superando el postulado legal conforme al cual «El suelo se valorará según su clase y situación» (art. 25 LS de 1998), esos terrenos pasaban a ser valorados como urbanizables, siempre y cuando la infraestructura que justificase su expropiación estuviese destinada a «crear ciudad». Tras el intento fracasado del legislador de finiquitar esta doctrina en 2002, han sido la Ley 8/2007 de Suelo y legislaciones posteriores las que, al omitir cualquier referencia a la clasificación urbanística y atender exclusivamente a la situación fáctica o real del suelo, hacen inaplicable sin más la doctrina de sistemas generales que crean ciudad.
Abstract:	Since the mid-nineties of the last century, a body of case law has been forging in the courts that endorsed the disconnection between land valuation and classification in the case of land destined for general systems that were classified as undevelopable or lacked specific classification. Surpassing the legal postulate that «Land will be valued according to its class and situation» (art. 25 LS of 1998), such land was valued as developable, provided that the infrastructure justifying its expropriation was intended to «create a city». After the failed attempt of the legislator to finalize this doctrine in 2002, it has been Law 8/2007 on Land and subsequent legislation which, by omitting any reference to the urban classification and attending exclusively to the factual or real situation of the land, make inapplicable the doctrine of general systems that create the city.
