Sintiencia animal : necesidad de un reconocimiento jurídico material, y sus implicaciones teóricas y prácticas

Los animales no humanos que ostentan la calidad de seres sintientes, son sujetos de consideración moral y, por tanto, titulares de derechos morales. Esto debe reflejarse en el mundo del derecho, que debe reconocer jurídicamente esa sintiencia, lo que hace necesaria la edificación una categoría jurídica propia para ellos, que los defina jurídicamente, y les reconozca unos derechos mínimos inviolables que se derivan, necesariamente, de la condición biológica de seres sintientes, a saber: el derecho a la vida, a la libertad, a la integridad y a la dignidad. Nonhuman animals qualified as sentient beings are subjects of moral consideration and are therefore holders of moral rights. This must be recognized in the legal world, which must legally recognize such sentience, making it necessary to construct a legal category specifically for them that legal defines them and recognizes minimum inviolable rights that necessarily derive from the biological condition of sentient beings, which are the right to life, to freedom, to integrity and to dignity. Covid-19 y animales, ¿una oportunidad para la abolición de la esclavitud especista?

La pandemia por SARS-COV-2, ha exigido al animal humano tomar acciones de salvaguarda, inclusive, lo ha llevado a reflexionar con mayor atención sobre su relación con los demás animales. Frente al panorama actual de contingencia, el ámbito jurídico debe prepararse para ampliar consideraciones de protección jurídica e iniciar el camino de la abolición de la esclavitud especista.
The SARS-COV-2 pandemic has required the human animal to take safety measures, including leading to deeper reflection on its relationship with other animals. Faced with the current state of contingency, the law must prepare itself to broaden legal protection considerations and begin on the path towards the abolition of speciesist slavery.

Based on the alterations of new scientific paradigms that sustain the demand for a relationship between humans and non-human animals founded on bioethics, this paper seeks to highlight the urgency in the creation of a new legal status for animals in Brazil, and the need of relocating Animal Law as an autonomous academic discipline.
En base a las alteraciones de nuevos paradigmas científicos que sostienen la demanda por una relación entre animales humanos y no-humanos basada en la bioética, el presente artículo busca destacar la urgencia de la creación de un nuevo estatuto jurídico para los animales en Brasil, y la necesidad de reposicionar el Derecho Animal como una disciplina autónoma.
