This paper attempts to perform a comparative analysis of both the American and the European Union legal system as it pertains to Land Use Law and, particularly, urban development. In order to do so, we will examine the differences in the distribution and exercise of competences between the States within the federatio in America as well as the Member States within the European Union, many of which have federal or equivalent regional systems themselves. This will lead to a natural analysis of the ways in which the EU compensates for a lack of express constitutionalism and delegation of powers, for which we will examine the transversal regulations of environmental protection and sustainable development, and property rights and public contracting law, as well as the relevant case law and the mechanisms through which they affect Land Use Law. Accordingly, each of this fields will be contrasted with the analogous American regulation as a counterpart. |
