El papel de la negociación colectiva en la representación preventiva : puntos críticos sobre su regulación e instrumentación

Abstract:	La regulación de la constitución y designación de la representación preventiva de los trabajadores se enfrenta a nuevos desafíos, como consecuencia de la irrupción de nuevas formas de organización empresarial basadas en la economía colaborativa. La descentralización y la desaparición de la realidad física del centro de trabajo afectan negativamente a la defensa de la seguridad y salud en el trabajo, dado que atomizan la representación, e incluso puedellegar a eliminarla. Estas circunstancias obligan a repensar el papel de los agentes sociales, bien desde la perspectiva de la eficacia de las opciones que ofrece la LPRL, bien desde las previsiones que se instrumentan en los convenios colectivos. Ante este escenario, este artículo se centra en analizar el estado actual del marco jurídico y convencional de la representación preventiva, examinando a tal efecto el papel que ha desempeñado la negociación colectiva para incrementar la eficacia de la figura del delegado de prevención.
Abstract:	The regulation of the constitution and designation of preventive representation of workers faces new challenges, as a result of the irruption of new forms of business organization based on the collaborative economy. Decentralization and the disappearance of the physical reality of the workplace negatively affect work occupational safety and health, since they atomize representation, and may even eliminate it. These circumstances make it necessary to rethink the role of social agents, either from the perspective of the effectiveness of the options offered by the LPRL or from the provisions implemented in collective agreements. Given thisscenario, this article focuses on analyzing the currentstate ofthe conventional framework of preventive representation, examining for this purpose the possibilities of collective bargaining to increase the effectiveness of the regulation of the LPRL.
