Abstract: La investigación analiza el concepto socio-jurídico de la maternidad y la paternidad en el ordenamiento jurídico español en el ámbito de la protección social. El objetivo central de la investigación ha sido el análisis del concepto de maternidad y paternidad que comparten las mujeres y hombres entrevistados, para contrastarlo con el concepto de maternidad y paternidad que presupone el ordenamiento jurídico español en el ámbito de la protección social. Igualmente ha sido clave analizar cuál es el rol del Estado que los ciudadanos/as esperan en materia de maternidad y paternidad y cuál es el papel asignado a ese Estado por los principales textos legales estudiados en esta tesis dentro del marco de un Estado Social de Derecho. La metodología utilizada en esta investigación ha combinado la metodología jurídica, especialmente la jurídico feminista, y la sociológica. La tesis está estructurada en cuatro capítulos. El capítulo primero está dedicado a analizar la evolución del pensamiento feminista y el pensamiento iusfilosófico sobre la maternidad y la paternidad. En primer lugar, se realiza un recorrido histórico del pensamiento feminista sobre la maternidad y la paternidad desde la Ilustración hasta la actualidad, concediendo una atención especial a la jurisprudencia feminista. En segundo lugar, se analizan las aportaciones del pensamiento jurídico-filosófico a la maternidad y la paternidad desde una perspectiva histórica. El capítulo segundo está dedicado al rol del estado en relación a la maternidad y la paternidad. Para ello, se estudia el tratamiento que el Estado Liberal del Derecho ha dispensado a las mujeres como ciudadanas y sujetos de derecho. A continuación se realiza un análisis sobre el papel que el Estado Social de Derecho juega en las cuestiones relativas a la maternidad y la paternidad de los sujetos, y qué tratamiento jurídico-político reciben estas dimensiones de la vida de las personas dentro de los objetivos sociales de este modelo estatal. Y para terminar, se abordan las diferencias que el Estado Constitucional aporta a este tratamiento jurídico, finalizando con el debate doctrinal sobre la existencia de un derecho a la reproducción. El capítulo tercero estudia el tratamiento jurídico de la maternidad y la paternidad en el ordenamiento jurídico español. Primero se mencionan los antecedentes históricos de la legislación actual española, así como la influencia y orígenes internacionales y europeos de dicha legislación. Posteriormente se procede al análisis de las principales regulaciones legales sobre maternidad y paternidad en el ámbito de la protección social y de las técnicas de reproducción asistida, para estudiar la finalidad de las normas que abordan la maternidad y la paternidad en la legislación española, y descubrir cuáles son los fines últimos que se persiguen a través de estas disposiciones normativas, qué intereses o bienes jurídicos se está intentando proteger o amparar, y a qué sujetos normativos están dirigidos. En el capítulo cuarto se procede al análisis sociológico de la maternidad y la paternidad, donde se recogen los principales resultados del trabajo de campo realizado a lo largo de esta investigación, estructurados en torno a las opiniones de la ciudadanía sobre la maternidad y la paternidad, las experiencias de la ciudadanía sobre la legislación vigente sobre maternidad y paternidad en el ordenamiento jurídico español y las demandas y expectativas de los/las ciudadanos/as frente al Estado dentro del modelo de estado de bienestar. Por último, se ha elaborado un capítulo de conclusiones que resume los principales resultados de la investigación realizada y donde se argumenta la necesidad de en el marco de un Estado Social de Derecho, abandonar una legislación de protección de la maternidad y avanzar en la construcción de un nuevo derecho a ser cuidado de todo ciudadano/a.
Abstract: This research analyses the socio-legal concept of maternity and paternity contained in the Spanish legal system in the context of social protection. The main aim of the research is to analyse the interviewees' concept of maternity and paternity and to compare it with the Spanish legal system's concept of maternity and paternity in the context of social protection. Similarly, an important component of the thesis is the analysis of what citizens expect from the state as regards maternity and paternity and what the state's role is as regards the main legal texts studied in this thesis, in the frame of a social state based on the rule of law. The method to be employed in this research has been a combination of the methods used in law, particularly feminist law and sociology of law. This thesis is structured in four chapters. The first chapter deals with the evolution of feminist thinking and the philosophy of the law's thinking on maternity and paternity. Firstly, we carried out a historical outline of feminist thinking on maternity and paternity from the Enlightenment until now, with special emphasis on feminist jurisprudence. Secondly, the contributions of the philosophy of law's thinking on maternity and paternity were analysed from a historical point of view. The second chapter is devoted to the role of the state with regards to maternity and paternity. To this end, we have examined how a liberal state based on the rule of law considers women as citizens and subjects of law. There follows an analysis on the role played by the social state based on the rule of law in the issues of parenthood, maternity and paternity of its subjects, and what legal and political considerations this aspect of life (parenthood) have been given by the social objectives of this type of state. The end of the chapter deals with the differences brought in by the constitutional state regarding this legal consideration. Lastly, we have pondered from a philosophical point of view on the existence of a right to reproduction. The third chapter deals with the legal treatment of maternity and paternity in the Spanish legal system. Firstly, we have provided the historical antecedents of the existing Spanish laws, as well as the European and international influences and origins of these laws. Later, we have analysed the main acts and regulations concerning maternity and paternity in the context of social protection and assisted reproduction techniques, in order to consider the objective of the laws concerning maternity and paternity within Spanish law and to discover what the ultimate objective is of these acts and regulations, what their interests are or what the legal assets are that are being protected or covered, and who are the normative subjects for whom these laws are intended. In the fourth chapter, we have analysed parenthood, maternity and paternity from a sociological point of view. Here, we have shown the main results of the field work carried out for this research, which has been structured around citizens' opinions on parenthood, maternity and paternity, citizens' experiences of existing maternity and paternity laws in the Spanish legal system and the demands and expectations of male and female citizens from the state within the welfare state. Lastly, we have written a conclusive chapter gathering the main results of the research carried out during the production of this PhD thesis where we argued the need to abandon a legislation focused on maternity protection to advance in building a new right to be care of all citizens within the framework of a Social state of law.
