El presente artículo tiene por objeto exclusivo, no el de realizar un análisis pormenorizado del articulado de la nueva ley chilena de Tenencia Responsable de Mascotas y Animales de Compañía, Nº 21. 020 de 2017, sino el de poner en relieve algunos de sus puntos jurídicamente más controversiales. Ello se hace necesario dada la vastamente comentada vaguedad conceptual y dispositiva que le caracteriza, propia de una redacción no experta tanto en temas de derecho animal en particular como del derecho en general. De esta forma, pretende responderse finalmente a la interrogante respecto a si la nueva norma representa un real y positivo avance para la situación de los animales en Chile o si, por el contrario, su intrincada y poco docta redacción, unida a la falta de visión de una política pública armónica, derivará en definitiva en una norma de imposible realización práctica. |
| Abstract: |
The present article aims exclusively not carry out a detailed analysis of the articles of the new Chilean law on Responsible Ownership of Pets and Companion Animals, No. 21. 020 of 2017, but to highlight some of its most controversial legal points. This is made necessary by the widely discussed conceptual and regulatory vagueness that characterizes it, typical of an inexpert wording particularly on issues of animal law, as well as on the law in general. In this way, it intends to put to rest the question of whether the new regulation represents a real and positive advance for the situation of animals in Chile or whether, on the contrary, its intricate and poorly written wording, together with the lack of vision of an harmonic public policy, will ultimately result in a regulation of impossible practical realisation. |
