Vulnerability in the context of EU asylum policies : the challenges of identification and prioritisation

Resum:	Vulnerability as a criterion for allocating rights and protection is an emerging concept in the current EU asylum legislation (Dir. 2003/9) and ECtHR case-law. The existence of vulnerable groups or applicants with special needs has been recently addressed by the relocation decisions (Council Decision 2015/1601) and it is also extremely relevant for the proposed resettlement regulation, currently under discussion (COM/2016/468final). According to the relocation and resettlement programmes, being eligible as a member of a vulnerable group would increase the possibilities of qualifying for asylum and will prioritize to benefit from relocation. Dealing with vulnerability can indeed advance protection for those especially in need and protect them since the outset of their application. However, two existing externalities have to be considered. First, a risk of "refugee shopping" phenomenon (or "cherry picking") since refugee's qualification is based on vulnerability but States are also able to select refugees drawing upon a national interest-oriented basis, with criteria ranging from skills to religion. Second, the regulation introduces immigration and home affairs policy concerns into the asylum domain. This is due by the fact that third countries partners for resettlement are selected basing upon -inter alia- exogenous elements such as an effective commitment in the fight against irregular migration. In addition, vulnerability criteria have to be carefully assessed against the risk of introducing multiple refugee status, which could potentially lead to address only the vulnerable/skilled individuals and disregard "ordinary" refugees. Against this background, the paper will ask the following questions: Would the scheme of vulnerable/skilled selection process lead to a refugee shopping system? Will relocation and resettlement enhance protection by addressing vulnerable groups or do they entail a potential risk represented by the transplant of migration policy objectives into the asylum domain? To this end, the paper will firstly cover how the concept of vulnerability has been introduced in EU asylum legislation, considering EU and non-EU case law. Then, vulnerability will be examined in the context of relocation and resettlement, considering both its enhancement of protection and its potential shortcomings.
