Abstract: La comisión de crímenes internacionales se considera un acto tan grave que, además de los individuos, la comunidad internacional en su conjunto se posiciona como la gran ofendida y los condena expresamente. Pero cuando los responsables son Jefes de Estado o de Gobierno la inmunidad de jurisdicción penal que les confiere su cargo puede constituir un obstáculo para su persecución. El presente trabajo busca conocer el tratamiento que recibe en la actualidad este privilegio tan abstracto ante las jurisdicciones nacionales e internacionales. Para ello, estudiaremos las disposiciones de la normativa internacional y los pronunciamientos doctrinales y jurisprudenciales más importantes y repasaremos su transformación a lo largo de la historia desde que se tomase conciencia de la importancia de los derechos del ser humano. Finalmente, se analizarán tres de los casos más relevantes que se han vivido en los tribunales en este sentido y que han puesto de manifiesto y han intentado aportar una solución a esta situación que compromete el ejercicio del derecho a la justicia.
Abstract: The commission of international crimes is considered such a serious act that, besides from the individuals, the international community positions itself as the offended party and purposefully condemns them. However, when the ones responsible are the Heads of State or Government, the immunity from criminal jurisdiction that their positions grant them can constitute an obstacle for their persecution. The objective of this project is to determine the treatment this abstract privilege receives at the present time in front of the national and international jurisdictions. To do it, we will study the provisions of the international law and the most important doctrinal and jurisprudential pronouncements and we will review its transformation throughout history since we became aware of the importance of human rights. Lastly, will be analyzed three of the most relevant cases that have passed through the courts relating to this topic and that have expounded and tried to provide a solution to this situation which compromises the practice of the right to justice.
