En el presente trabajo la autora examina distintos paralelismos en cuanto a la flexibilidad y elasticidad de la institución de la curatela en Roma, que posibilitan la vigencia de las soluciones romanas en la reforma de la Ley 8/2021, de 2 de junio, por la que se reforma la legislación civil y procesal para el apoyo a las personas con discapacidad en el ejercicio de su capacidad jurídica, teniendo en cuenta que la preeminencia del principio de la voluntad de la persona discapacitada deriva de implementación en este ámbito de los Derechos Humanos.
In this paper, the author examines different parallels in terms of the flexibility and elasticity of the institution of guardianship in Rome, which make possible the validity of Roman solutions in the reform of Law 8/2021, of 2 June, which reforms civil and procedural legislation to support persons with disabilities in the exercise of their legal capacity, taking into account that the pre-eminence of the principle of the will of the disabled person derives from the implementation in this area of Human Rights.
